Article 1: THE “COLETTE EN BAIE” GITE SERVICES These conditions relate to the short-term rental of the “Colette en Baie de Somme” tourist gite.
Article 2: DURATION OF STAY The client, signatory of the present contract concluded for a fixed period, may not under any circumstances claim any right to remain in the premises at the end of the period of stay.
Article 3: LIABILITY The “COLETTE EN BAIE DE SOMME” service which offers services to a client is the sole interlocutor of this client, and is responsible to him for the execution of the obligations arising from the present conditions of sale. It cannot be held responsible for fortuitous events, cases of force majeure or the actions of any person who is not involved in the organisation and running of the stay and the services provided on this occasion.
Article 4 : RESERVATION The reservation becomes firm when it is paid in full.
Article 5 : ABSENCE OF RETRACTION Reservations are made by internet, the tenant does not benefit from the withdrawal period, and this in accordance with the article L121-21-8 of the code of consumption relating in particular to the services of lodging provided at a date or according to a determined periodicity.
Article 6: PAYMENT OF THE AMOUNT The customer formally undertakes to pay the “COLETTE EN BAIE DE SOMME” service the entire amount due. Therefore, full payment will be required at the time of booking. If there are additional costs, these will be deducted from the deposit.
Article 7: CERTIFICATE OF PAYMENT As soon as the balance of the cost of the stay is received, the “COLETTE EN BAIE DE SOMME” service sends the client a receipt.
Article 8: ANIMALS Animals are not allowed. Article 9: ARRIVAL The client must arrive on the specified day and at the times mentioned on the contract or an acknowledgement of receipt. If this is not possible, he/she must inform the “COLETTE EN BAIE DE SOMME” service. In the event of late arrival or last minute cancellation, the client must inform the service provider directly. No reimbursement will be made for services not consumed as a result of this delay.
Article 10: CANCELLATION BY THE CUSTOMER Any cancellation must be notified to the “COLETTE EN BAIE DE SOMME” Service, by registered letter or by e-mail. The amount that will be reimbursed to you by the reservation service, with the exception of the handling fee, will be as follows :
– Cancellation up to and including the 15th day before the start of the stay: 50% of the price of the stay and the services directly linked to the stay will be retained, if the customer has chosen to benefit from them.
– Cancellation less than 15 days before the beginning of the stay: no refund will be made.
Article 12: INTERRUPTION OF THE STAY In the event of interruption of the stay by the client, no refund will be made.
Article 13: CANCELLATION BY THE SELLER When, before the start of the holiday, “COLETTE EN BAIE DE SOMME” cancels this holiday, it must inform the buyer by registered letter with acknowledgement of receipt or by e-mail. The buyer will be reimbursed immediately and without penalty of the amounts paid.
Article 14: MODIFICATION OF A SUBSTANTIAL ELEMENT When, before the planned date of the start of the “COLETTE EN BAIE DE SOMME” holiday, the purchaser is obliged to make a modification to one of the essential elements of the contract, the purchaser may, without contravening the previous articles, and after having been informed of this by the vendor by registered letter with acknowledgement of receipt or by email:
– Or terminate the contract and obtain an immediate refund of the sums paid without penalty.
– Or accept the modification or substitution of places of stay or activities proposed by the seller: an amendment to the contract specifying the modifications made is then signed by the parties.
Any reduction in price will be deducted from any sums still owed by the purchaser and if the payment already made by the latter exceeds the price of the modified service, the excess amount will be returned to the hirer before the beginning of his stay. Inability of the seller to provide the services provided for in the contract during the stay: when, during the stay, the seller is unable to provide a major part of the services provided for in the contract, representing a non-negligible percentage of the price paid by the purchaser, “COLETTE EN BAIE DE SOMME” will offer a stay in place of the one provided for by the contract, and will possibly bear any additional costs. If the stay accepted by the buyer is of inferior quality, “COLETTE EN BAIE DE SOMME” will reimburse the difference in price before the end of the stay. If the seller is unable to offer a replacement stay or if this is refused by the buyer for valid reasons, the former shall pay the latter compensation calculated on the same basis as in the case of cancellation by the seller.
Article 15: CAPACITY The contract is established for a maximum number of persons. If this number is exceeded, the provider reserves the right to refuse additional clients. Any modification or termination of the contract will be considered at the client’s initiative, the sale price will remain with the reservation service.
Article 16: INSURANCE The client is responsible for all damage caused by him. He is required to be insured by an insurance contract for these different risks. This contract is known as a holiday contract in the particular case of furnished tourist accommodation.
Article 17: STATEMENT OF PREMISES A list of all the elements considered to be functional and without defects at the time of rental is made available to the client who has 4 hours to report any defects. This list is the only reference in the event of a dispute concerning the state of the premises. The tenant is obliged to use the rented property with due care. The state of cleanliness of the gîte on the tenant’s arrival must be noted in the inventory of fixtures. The cleaning of the premises is the responsibility of the Tenant during the rental period and before departure. The amount of any cleaning costs is established on the basis of the calculation mentioned in the description.
Article 18 : GUARANTEE DEPOSIT Via the internet, a guarantee deposit, the amount of which is indicated on the description sheet, is requested by the owner. After the inventory of fixtures at the end of the stay has been drawn up by both parties, this deposit is returned, less the cost of restoring the premises if any damage has been found. In the event of early departure (before the times mentioned on the description sheet) preventing the inventory of fixtures from being drawn up on the same day as the tenant’s departure, the security deposit is returned by the owner within a period not exceeding one week.
The refund is made by bank transfer.
Article 19: DISPUTES Any complaint relating to the state of the premises and/or the state of the description of the place of stay, must be submitted to the lessor within 4 hours of entering the premises. Any other complaint must be addressed to him as soon as possible, by letter or e-mail.
